1. By registering for and/or undertaking the E-learning course module(s) as defined below, participants are bound by, and comply with, these Terms and Conditions. It is the individual’s responsibility to read and understand these Terms and Conditions.
2. For the purposes of these Terms and Conditions the “E-learning course module(s)” means the E-learning course module(s) the details of which are as confirmed in the written booking arrangements between the participant and Manufacturing Leaders Ltd. (hereinafter referred to as “the Organiser”).
3. In order to undertake the E-learning course module(s), participants must pay in full or have paid in full on their behalf the relevant course fees immediately on booking or by the invoice due date. If you are located in the European Union, according to the European Union reverse-charge regulation any tax liability transfers to the recipient of services.
4. All E-learning course modules will be delivered by the Organiser entirely online through the internet and will be hosted on a Learning Management System. Each course module will include Microsoft PowerPoint slides with embedded pre-recorded video of the Course Tutor teaching the course module and will be made available to participants on an on-demand basis (i.e., not live).
5. Upon booking and full payment by the participant of all course fees due, the Organiser will provide the participant with online access to the purchased course module(s). The participant will be granted access to those course module(s) for a period of 90 days from the date of purchase. It is the participant’s responsibility to undertake and complete all course modules purchased within this 90-day access period.
6. Participants are responsible at their own expense for ensuring they have suitable internet access and computer equipment to enable them to access the course module(s) online via the internet. Participants are solely responsible for ensuring that they are not prevented from accessing the E-learning course module(s) online by any firewall or IT security measures that they or their company have in place.
7. If an invoice is requested, payment must be made by the invoice due date and no access to the E-learning course module(s) will be granted until full payment is received by the Organiser. If payment is not received within these required time limits, the Organiser reserves the right to cancel the booking without notice. Payment may be made by credit card or bank transfer. Please indicate your Booking Reference and surname as a reference on all bank transfers and communications.
8. Payments made for the E-learning course module(s) are non-refundable.
9. The Organiser reserves the right to cancel a participant’s booking at any time and for whatever reason upon repayment of any course fees received for the relevant course module(s) and this repayment shall be in full and final settlement of any claims against the Organiser by the participant relating to his/her booking for the E-learning course module(s).
10. By submitting registration details, you agree to allow the Organiser to contact you as required for the administration of the relevant E-learning course module(s) booked. The Organiser will comply with the terms of our Privacy Policy when we handle your registration details and any other of your personal information.
11. We may contact you for marketing purposes to make you aware of other relevant E-learning courses, Events and services provided by the Organiser and will comply with the terms of our Privacy Policy when doing so.
12. Where a participant registers for an E-learning course module(s) and is provided with online access by the Organiser, only that registered participant is entitled to access and undertake the course module(s). The participant agrees not to share their account log in information with any third party or otherwise facilitate them to access the E-learning course module(s) by using the participant’s e-learning account without the prior written consent of the Organiser.
13. The participant agrees that access to the E-learning course module(s) is granted solely for the purpose of his or her ongoing personal training, learning and professional development. Participants agree not make any audio or video recording of all or any part of the E-learning training course module(s) that they have access to and not to copy, reproduce or distribute any part of the E-learning course module(s) and materials or use them for any other purposes.
14. These Terms and Conditions, together with the registration form, constitute the entire agreement of the parties and may be executed by electronic signature. The participant hereby waives any and all rights to dispute the validity, legality or enforceability of such method of execution as evidence of the existence of legal relations pursuant to this agreement for the purposes of proceedings issued in respect of their terms. In entering into this agreement, the parties have not relied on, and shall have no remedy in respect of, any statement, representation, warranty, understanding, promise or assurance (whether negligently or innocently made) of any person other than as expressly set out in this agreement. Each participant shall be deemed to have full knowledge of the Terms and Conditions and shall be bound by them in all respects.
15. To the full extent allowed by law and insofar as it is reasonable to do so, the participant agrees not to hold the Organiser liable for any damage or loss suffered or incurred by the them whilst undertaking the E-learning course module(s), including consequential losses (i.e. losses which are not incurred as a direct consequence of the E-learning course leading to any claim) or indirect losses or loss of profit, through registering for the E-learning, undertaking the E-learning, the use of any third party learning management system, postponement or cancellation of the E-learning, or any error or omission on the part of the Organiser. This provision does not reduce or restrict the Organiser’s liability for death or personal injury caused by its negligence or fraud.
16. By accepting these Terms and Conditions the participant warrants that he/she is undertaking the E-learning in the course of his or her business and indemnifies the Organiser and its staff and agents against all or any loss or damage, injury, actions, proceedings or claims arising from any act or omission of the individual during the course of the E-learning.
17. The views expressed by any Course Tutor during the E-learning course module(s) are representative of the Course Tutor’s own opinions and cannot in any way be attributed to the Organiser. The Organiser disclaims any liability for views expressed by any Course Tutor during the E-learning course module(s).
18. These Terms and Conditions may not be modified, amended or rescinded, in whole or in part, except by written amendments signed by both parties.
19. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales and each party irrevocably agrees to submit to the exclusive jurisdiction of the English courts.
